WTO Dispute Settlement Timeline

EVENTDATE AND/OR STANDARD WTO TIME FRAME
Complaining parties (United States, Argentina and Canada) request consultations May 13, 2003
Complaining parties and respondent (EU) hold consultations (third parties may also join with the agreement of the respondent; these include Australia, Chile, Colombia, El Salvador, Honduras, Mexico, New Zealand, Peru and Uruguay) Within 30 days of request unless otherwise agreed
Actual: mid-June 2003
Complaining parties request establishment of panel (assuming unsuccessful consultations) No earlier than 60 days after request for consultations
Actual: mid-August 2003
Panel established at Dispute Settlement Body (DSB) meeting No later than at second DSB meeting at which request appears on agenda
Panel composed and terms of reference set Within 20 days by agreement, or within 30 days if Director-General is requested to select panel
Panel circulates final report to all WTO members Within 9-10 months of composition (based on actual experience)
Estimated date: July 2004
Complaining parties or respondent appeal(s) final report or DSB adopts panel report Within 60 days of report circulation
Appellate Body circulates report (assuming appeal) Within 60-90 days of notice of appeal
Estimated date: January 2005
DSB adopts Appellate Body and panel reports Within 30 days of circulation of Appellate Body report
Respondent implements panel recommendations (assuming respondent's measures found in violation) Guideline: within 15 months of adoption of report(s)
Estimated date: Mid-late 2005
